These terms govern your use of StarUp. Using the service means you accept them. If you do not accept them, do not use the service.
The service
StarUp sends review requests to a business's customers after a completed job, and reports on the results.
The service requires an account. The account holder is responsible for keeping credentials safe and for everything done under the account.
Your responsibilities as a business
Making sure you have a lawful basis to contact every customer whose details you send us, and complying with the law on sending messages — including section 30A of the Communications Law (Telecommunications and Broadcasts), 5742-1982.
Making sure the data you send is accurate and that you are entitled to send it.
Honouring opt-outs and responding to customers' questions about their data.
Not using the service to send advertising, bulk messages, or anything unrelated to work actually performed.
Reviews
StarUp asks for reviews. It does not write them, does not offer anything in exchange for them, and does not screen customers by predicted sentiment before asking.
Using the service to manufacture reviews that are not genuine breaches these terms and Google's policies, and can result in your account being closed and in Google penalising your profile.
Content a customer publishes belongs to them and is published subject to Google's terms. We have no control over whether a review is published, removed or ranked.
Connections to other services
The service connects to external systems — invoicing, Google, messaging providers. Your use of those is also subject to their terms.
An outage, change or discontinuation at an external provider may affect StarUp. We will make reasonable efforts to warn and to fix, but we are not responsible for services outside our control.
Payment
Commercial terms — plan, price and billing period — are those presented at sign-up or in a separate agreement.
You can cancel at any time. Cancellation takes effect at the end of the current billing period, unless the law provides otherwise.
Availability
We aim for high availability but do not promise uninterrupted, error-free service. There may be maintenance windows.
Message delivery depends on mobile networks and third-party providers. We cannot guarantee that every message is delivered.
Liability
The service is provided as is. To the fullest extent permitted by law, we are not liable for indirect or consequential damages or lost profits.
In any event our total liability will not exceed the amounts actually paid to us in the twelve months preceding the event.
Your data
The data you send remains yours. We process it only for you, in line with the Privacy Policy.
On termination you can export your data. After that it is deleted in line with our retention policy.
Termination
Either party may end the arrangement. We may suspend an account that operates in breach of these terms or that puts the service or other users at risk.
Governing law and jurisdiction
These terms are governed by Israeli law. The competent courts of the Tel Aviv district have exclusive jurisdiction.
Changes to these terms
We will give notice of material changes in advance. Continuing to use the service after a change takes effect means you accept it.
